How do you appeal a TVB conviction in New York?

Sometimes, a New York traffic ticket means the difference between continuing to drive as you have been and having to turn your license over to the state. When you have so much on the line, you may decide to appeal a traffic court’s decision to convict you of an offense and assign points to your driver’s license.

Per the New York State Department of Motor Vehicles, you have the option of appealing a conviction handed down by the Traffic Violations Bureau in one of two ways.

Appealing a TVB ticket by mail

If you decide to appeal the TVB’s decision to convict you of a particular traffic offense via mail, then you have to do so within 30 days of the date you received your conviction for the offense. You may access the TVB Appeal Form you need to do so on the New York DMV website. Then, you need to submit your Appeal Form and any applicable fees within that 30-day window.

Appealing a TVB ticket online

You have the option of appealing your traffic ticket online if you received your conviction within the past 30 days and it came from the TVB. Tickets from the TVB should have clear markings at the bottom indicating they came from there, rather than the DMV. When formulating your appeal, you have a chance to make your argument about why you feel your conviction is without merit. If you have more than one ticket to appeal, you need to create separate transactions for each.
