As a commercial driver, what happens if you receive a pink ticket for a safety violation such as a brake system defect?
In New York, pink ticket offenses are often misdemeanors, which can result in a permanent criminal record if you violate the law. You cannot operate a commercial vehicle in this state unless you comply with the safety rules imposed under the Transportation Law. For example, if your truck has a brake system defect, it will remain out of service until you make the repair.
You have 15 days in which to make repairs to correct the brake system defect. The fine associated with this “pink summons” is from $350 to $1,000. Depending on the circumstances, you could also face up to 60 days behind bars. For a subsequent violation within 18 months, the fine ranges from $1,000 to $2,500.
According to Transportation Law, Section 140.2, no commercial vehicle “shall be operated in this state unless it is in compliance with the department’s safety rules and regulations.” Traffic tickets can lead to a license suspension as well as a substantial increase in insurance premiums.
